Services We Are Not Required to Provide

When you first hire Nissenbaum Law Offices, it is with the understanding that we will provide the legal services necessary to achieve the best possible outcome for your divorce. However, there are some services which fall outside that agreement and which we are not required to perform.

If you ask us to handle those additional matters, and we conset to do so, we shall have to agree on a new fee for each separate item. If no separate retainer contract is signed and we agree to do the work, then the terms of your original contract will be applicable to the new work.

  1. We have no duties after a settlement, entry of a judgment nisi or after the trial court has ruled on any post trial motions.
  2. We do not have to take any appeals to a higher court for you.
  3. We do not have any duty to handle the following matters, even though they involve you and your property:
    1. Selling your home or other property.
    2. Appearing in the Juvenile, Municipal, District, Land, Housing or Superior courts.
    3. Appearing in the Single Justice Sessions of either the Massachusetts Supreme Judicial Court or The Appeals Court.
    4. Preparing your Will (in Massachusetts a dissolution of the marriage revokes the provisions of your will as they relate to your spouse).
    5. Suing family corporations or other persons.
    6. Defending a suit by a lender who wishes to take away your home or other asset.
    7. Defending suits by others who want you to pay them money.
    8. Handling any other matter that is not in the Probate and Family Court Department of the Massachusetts Trial Court.
